These Terms and Conditions apply to all
sales conducted in-store and online through the BretoHome website.
2. Scope & Acceptance
By accessing our website, placing an order,
or purchasing products from BretoHome (either in-store or online), the customer
agrees to be legally bound by these Terms and Conditions.
If the customer does not agree, they must
refrain from using the website or purchasing products.
BretoHome reserves the right to amend these
Terms at any time. The version applicable to an order shall be the version in
force at the time of purchase.
3. Products & Product Information
BretoHome imports and sells furniture,
bedding products, outdoor furniture, office furniture, and decorative items
sourced from European, non-European and local manufacturers.
3.1 Product Descriptions
All product descriptions, dimensions, photographs, finishes, materials, and
specifications are provided in good faith. However:
- Minor variations in colour, texture, grain, stitching, finish,
or dimensions may occur.
- Natural materials (wood, fabric, leather, marble, etc.) may
present natural variations.
- Screen displays may not accurately reflect colour tones.
Such variations shall not be considered
defects.
3.2 Availability
Some products are available in stock, while others are supplied upon order.
Availability is subject to supplier confirmation.
BretoHome shall not be liable for
discontinued products or supplier production changes beyond its control.
4. Orders & Contract Formation
4.1 Order Confirmation
An order becomes legally binding only when:
- A written confirmation is issued; and
- A required deposit or full payment is received.
4.2 Deposits
Custom or special-order items require a deposit. Deposits are non-refundable
once production has commenced.
4.3 Refusal or Cancellation by Company
BretoHome reserves the right to cancel or refuse any order due to:
- Pricing errors
- Stock errors
- Supplier inability to fulfil
- Suspected fraudulent transactions
- Force majeure events
In such cases, any payment received will be
refunded.
5. Custom & Special Orders
Custom-made, made-to-measure, personalized,
or specially imported products manufactured according to the customer’s
specifications:
- Cannot be cancelled once production has begun
- Are non-returnable and non-refundable
- Are not subject to the 14-day withdrawal right under EU
Directive 2011/83/EU
Estimated delivery times:
- Imported custom products: approximately 2 months, possibly up
to 4 months depending on origin and manufacturer.
- Locally crafted products (Cyprus): approximately 2–4 weeks.
All timelines are indicative and not
guaranteed.
Delays caused by manufacturers, shipping
companies, customs, strikes, or force majeure shall not entitle the customer to
cancellation or compensation.
6. Pricing & Payment Terms
6.1 Prices
All prices are listed in Euro (€) and include VAT unless otherwise stated.
BretoHome reserves the right to adjust
prices at any time. Confirmed orders are not affected.
6.2 Accepted Payment Methods
- Bank transfer
- Credit/Debit cards
- Cash
- Cheques
Cheques must be cleared before delivery.
6.3 Retention of Title
Ownership of goods remains with A. ZAOS TRADING LTD until full payment is
received.
7. Delivery, Risk & Installation
7.1 Delivery
Delivery dates are estimates only.
BretoHome shall not be liable for delays
caused by:
- Manufacturers
- Shipping companies
- Customs authorities
- Events beyond reasonable control
7.2 Customer Responsibilities
The customer must:
- Ensure proper access to the premises
- Verify dimensions and access points (stairs, elevators,
doorways)
- Ensure safe delivery conditions
- In case forklift assistance is required, cost it’s a customer
responsibility.
If delivery fails due to customer
negligence, additional delivery charges may apply.
7.3 Transfer of Risk
Risk passes to the customer upon:
- Delivery to the provided address; or
- Collection from our premises.
7.4 Inspection
Customers must inspect goods upon delivery
and report visible defects within 24 hours in writing.
Failure to do so may result in waiver of
claims regarding visible damage.
7.5 Installation & Assembly
Installation services are provided where
agreed. BretoHome is not responsible for:
- Installation performed by third parties
- Structural inadequacies of customer premises
8. Right of Withdrawal (Online Consumers
Only)
For online purchases, EU consumers have the
right to withdraw within 14 calendar days from delivery, in accordance with EU
Consumer Protection legislation.
This right does NOT apply to:
- Custom-made or personalized goods
- Goods manufactured to customer specifications
- Goods assembled after delivery
- Goods used beyond necessary inspection
Returned goods must:
- Be unused
- Be in original packaging
- Be in resaleable condition
Return shipping costs are borne by the
customer unless legally required otherwise.
Refunds are processed within 14 days of
receipt and inspection of goods.
9. Returns – In-Store Purchases
In-store purchases are not subject to
automatic withdrawal rights.
Returns are accepted only where required
under Cyprus consumer law or at the discretion of management.
Custom and special-order products are
non-returnable unless defective.
10. Warranty & Legal Guarantee
All consumer products are covered by the
statutory 2-year legal guarantee under EU and Cyprus law.
Certain products may carry extended
manufacturer warranties (2–10 years depending on brand).
Warranty does not cover:
- Normal wear and tear
- Improper maintenance
- Accidental damage
- Exposure to unsuitable environmental conditions
- Unauthorized repairs or modifications
Warranty claims require original proof of
purchase.
BretoHome reserves the right to repair,
replace, or refund at its discretion in accordance with applicable law.
11. Limitation of Liability
To the fullest extent permitted by law:
- BretoHome shall not be liable for indirect, incidental, or
consequential damages.
- Liability shall not exceed the purchase value of the product
concerned.
- BretoHome shall not be responsible for delays or
non-performance due to force majeure events.
Nothing in these Terms limits statutory
consumer rights under EU or Cyprus law.
12. Intellectual Property
All website content including logos, text,
images, design, and branding is the property of A. ZAOS TRADING LTD and
protected under intellectual property laws.
Unauthorized use is strictly prohibited.
13. Governing Law & Jurisdiction
These Terms and Conditions are governed by
the laws of the Republic of Cyprus and applicable European Union legislation.
Any disputes shall be subject to the
exclusive jurisdiction of the Cyprus courts.
